Every parent would prefer seeing their children or a charity inherit their estate with little or no taxes. Our firm can plan an estate to reduce the estate taxes and still meet the family goals of inheritance, control, and asset protection. We can implement a myriad of strategies from the most simple will or trust to charitable strategies, such as Charitable Foundations, or other more complicated strategies to achieve our clients’ estate planning goals.

Transferring Estate Assets

After a family member dies, if the decedent had a will there is a probate action in a Florida court. If the decedent had a trust, there is a trust administration. In both cases, these are required to pass property down from the elder generation to the next generation.

Probate requires a minimum of six months in court, so that creditors and other issues have an opportunity to be heard. Many families prefer to avoid probate, due to the time and expense incurred, so they have our firm design a trust for the family. Typically a trust can be transferred with less time and expense since there is no court involvement.
